TERMS & CONDITIONS FOR PRIZE PROMOTIONS
These are the terms and conditions which apply to prize draws, prize competitions or other prize promotions which we may run, whether on our websites, social media platforms or otherwise (‘Promotion’).
By entering a Promotion, you agree to be bound by these terms and conditions (“Terms and Conditions”) along with any other specific terms which relate to a Promotion (“Specific Terms”). Specific Terms might include entry instructions and any other specific details, rules or conditions relating to a particular Promotion, and might be published on our websites, social media platforms, or may be found in any other media which features a Promotion.
The Specific Terms will reference the following Terms and Conditions:
1. THE PROMOTER
The Promoter is Kenvue UK Limited of 50-100 Holmers Farm Way, High Wycombe, HP12 4EG United Kingdom unless the Promotion is only open to residents of Ireland, in which case the Promoter is JNTL Consumer Health I (Ireland) Limited of Office 5, 6 & 7, Block 5, High Street, Tallaght, Dublin 24, D24 YK8N, Ireland (each the “Promoter”).
2. THE PROMOTION
2.1. The Promotion is only open to residents in the United Kingdom aged 18 years or over unless the Specific or
other promotional materials or announcements specify a different geographic region or a different
minimum age.
2.2. If the Specific Terms allow entry under the age of 18, you must obtain parental or guardian consent to enter
and claim your prize. The Promoter may ask the winner to provide proof age.
2.3. Employees (and members of their immediate families/households) of the Promoter, its affiliated companies,
their agencies and anyone professionally connected with the Promotion are excluded from entering.
2.4. Unless otherwise expressly stated in the Specific Terms:
2.4.1.In the case of a prize draw, winner(s) will be selected at random from the valid entries. Winner(s) will be
selected using randomized software or at random under independent supervision, or as otherwise
mentioned in the Specific Terms.
2.4.2.In the case of a prize competition, entries will be judged and winner(s) will be selected from valid
entries. Winner(s) will be selected by an independent judge or a panel of judges which includes at least
one independent judge. The decision of the panel of judges (acting reasonably) will be final. Upon
request, the Promoter will provide the full names of the judges to anyone who emails
consumer-gb@kenvue.com within one month of the Closing Date (as defined below) of a Promotion.
2.4.3.In the case of a Promotion that is run across multiple participating websites or Social Media sites of the
Promoter, all valid entries will be combined in a single prize draw.
2.4.4.Depending on the method of entry to the Promotion, winner(s) of a Promotion will be notified by either
direct message, email, telephone or text within 7 days of the Date.
2.4.5.If a winner of a Promotion cannot be contacted, or does not claim the prize, within 21 days of
notification, the winner’s claim will become invalid, and the Promoter reserves the right at its absolute
discretion to withdraw prize entitlement. The Promoter can then award the prize to a substitute winner
selected at the same time as the original winner. If that substitute winner cannot be contacted, or does
not claim the prize, within 21 days of notification then the Promoter reserves the right at its absolute
discretion to withdraw prize.
2.5. The selection of the winner(s) is final and no correspondence or discussion will be entered into.
2.6. The Promoter will either publish or make available information that indicates that a valid award took place
for a Promotion. Upon request, the Promoter will provide the surname and county of the winner(s) to anyone
who emails consumer-gb@kenvue.com requesting this information within one month of the Closing Date of
a Promotion. Should you object to this information being published or made available, please send your
objection or a request to reduce the amount of information published or made available to
consumer-gb@kenvue.com within 7 days of the Closing Date. The Promoter will provide information and
winning entry to the ASA challenged.
2.7. Unless otherwise expressly stated in the Specific Terms, Promotions are in no way sponsored, endorsed or
administered by, or associated with any social media platform (including without limitation Meta,
X (formerly known as Twitter), TikTok or YouTube) (“Social Media”).
3. HOW TO ENTER
3.1. By submitting an entry, you, the person entering the competition (the “Entrant”), are agreeing to be bound by
these Terms and Conditions.
3.2. The Promotion will run from the date/time it is first promoted unless a later time is specified in the Specific
Terms or in promotional material related to the Promotion (the “Opening Date”). The closing date/time will
be specified in the Specific Terms or in promotional material to the Promotion (the “Closing Date”).
3.3. All entries must be received by the Promoter by no later than the Closing Date. All competition entries
received after the Closing Date are automatically disqualified.
3.4. The entry process will be explained in the Specific Terms of the Promotion and/or in promotional material
related to the Promotion.
3.5. Entering a Promotion is free of charge, unless otherwise specified in the Specific Terms. However, if required
to enter via text message, MMS, or telephone call, your network provider may charge you according to their
standard rate or deduct it from your allowance. Standard rate text messages to shortcodes related to a
Promotion are typically not included in 'inclusive' packages and may incur additional charges. Each
Promotion will have its own unique shortcode; check before submitting your entry. For more information
and details on charges, please contact your service provider. If you are not the bill payer, you must obtain
permission before entering.
3.6. If the Promotion requires the purchase of a product, proof of purchase, for example a receipt,showing
purchase of the product between the Opening Date and Closing Date must be submitted. The Specific
Terms will explain the method of submission and any requirement to keep packaging and/or proof of
purchase.
3.7. Photo or Video Submissions:
3.7.1.If the Promotion requires submission of a photo or video of the Entrant or their child depicting the
competition theme (the “Theme”), the Specific Terms will explain the method of submission and the
competition theme. The Entrant must provide all of the following information (together with the photo
or video, the "Material"):
a. Entrant’s name or personal identifier;
b. Entrant’s email address;
c. Entrant’s postcode;
d. If the Material includes a child/children, the child’s/children’s first name and age and consent of the
child’s/children’s parent or legal guardian.
3.7.2.By submitting an entry, the Entrant agrees that, subject to moderation in accordance with
the Terms and Conditions, the name(s), age(s) and picture or video included in the
Material, may be shown on the Social Media pages and/or website of the Promoter and be
viewed by members of the public.
3.7.3.Personal details included in the Material will only be used in accordance with these Terms and
Conditions.
3.7.4.Material can only be entered into the Promotion by the person, or if appliable, the parent or legal
guardian of the child or children featuring in it. The Material should not contain identifiable images
of any other adults and/or children; any Material that does contain an image of another adult and/or
child will be disqualified.
3.7.5. All Material will be pre-moderated by the Promoter before appearing as part of the competition. The
Promoter endeavours to make entries appear within a reasonable timeframe however please note that
moderation times may vary due to high volume of entries.
3.7.6.Video content should be no longer than the time stipulated in the Specific Terms; Material that is longer
will be disqualified.
3.7.7.By entering the Promotion, Entrants acknowledge and give their consent to photos and videos being
retained by the Promoter and used in the following way:
a. Future marketing and PR for the Promoter’s brand (“Brand”), for example on the Social Media pages, the
website and other sites, competition gallery on the website, on future Social Media posts and in any
montage film published on-line at the end of the Promotion.
b. In the event that any adverse events are reported as a result of the Promotion, any related images will
need to be retained by the Promoter indefinitely for legal reasons (adverse events means any unexpected
or unfavourable symptoms associated with the administration or use of a product, including overdose,
abuse/misuse of a product, withdrawal symptoms or lack of efficacy) (“Adverse Event”) sole discretion,
3.7.8.Any Material deemed inappropriate, incomplete, incorrect or unsuitable, in the Promoter's will be
disqualified from the Promotion and will not appear as part of the Promotion. Inappropriate and
unsuitable Material includes, but is not limited to:
a. pornographic or "off-colour",
b. political content or propaganda,
c. obscene, sexual, profane, lewd, or otherwise offensive,
d. nudity,
e. car license plates, phone numbers or personal addresses,
f. website or web page links,
g. derogatory characterizations of any ethnic, racial, sexual or religious groups,
h. any third-party materials, including music, that may otherwise violate or infringe (or may infringe)
copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or
deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity,
is otherwise objectionable,
i. showing clothing or other objects with visible logos, drawings, cartoons, phrases, trademarks or other
third-party materials,
j. any material that infringes or violates someone else's rights or the law,
k. any content or performance that has been broadcast or streamed, published or televised on television or
as part of a recording of a motion picture film or television programme,
l. not of satisfactory quality (i.e. brightness, focus, volume) to be streamed online,
m. defaming or invading publicity rights or privacy rights of any person, living or deceased, or otherwise
infringing upon any person's personal or proprietary rights,
n. containing Adverse Events or off-label use of the Promoter's, or its affiliates' products, drugs, or devices,
o. not complying with the Theme,
p. dangerous or where health and safety is in question.
3.8. The Promoter will not accept responsibility for entries that are lost, mislaid, damaged or delayed in transit,
regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical
malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
proof of posting or transmission as proof of receipt of entry to the Promotion. All internet connection
charges and any other expenses which may be incurred due to entering or winning the Promotion are the
sole responsibility of the Entrant.
3.9. For help with a Promotion that is advertised on Social Media, direct message the Brand account. For help
with all other Promotions contact consumer-gb@kenvue.com
4. ELIGIBILITY
4.1. By submitting an entry, you confirm that you are eligible to do so and eligible to claim the prize you may win.
The Promoter may require you to provide proof that you are eligible to enter the Promotion.
4.2. The Promoter will not accept entries that are: automatically generated by computer; completed by third
parties or in bulk; illegible, have been altered, reconstructed, forged or tampered with; photocopies and not
originals; or incomplete.
4.3. Unless otherwise specified in the Specific Terms, there is a limit of one entry to a Promotion per person and
multiple entries may cause you to be disqualified at the discretion of the Promoter. Entries on behalf of
another person will not be accepted and joint submissions are not allowed.
4.4. Unless otherwise specified in the Specific Terms, in the case of a Promotion that is run across multiple
participating websites or Social Media sites of the Promoter, where entries are combined to draw winners,
there is a limit of one entry per person for each website or Social Media site running the Promotion.
4.5. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of a
Promotion and to verify all entries including but not limited to asking for address and identity details
(which must be provided within 14 days of the request). The Promoter may refuse to award a prize or
withdraw prize entitlement, refuse further participation in a Promotion and disqualify the Entrant where
there are reasonable grounds to believe there has been a breach of these Terms and Conditions, the Specific
Terms, or promotional material related to the Promotion, or any instructions forming part of a Promotion’s
entry requirements or otherwise where an Entrant has gained unfair advantage in participating in the
Promotion or won using fraudulent means.
4.6. Entries for a Promotion cannot be returned.
5. THE PRIZE
5.1. The prize or prizes are as described in the Specific Terms and/or in promotional material related to the
Promotion.
5.2. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if
circumstances beyond the Promoter’s control make it necessary to do so.
5.3. Third party terms and conditions may apply to a prize, or parts of a prize. For example, where the prize
contains ticket(s) to an event, in addition to these Terms and Conditions and the relevant Specific Terms,
recipients of the prize will also be bound by any terms and conditions relating to the ticket and/or event.
5.4. In the case of a cash prize, it will be paid by bank transfer only to a valid UK bank account held in the
name of the winner; valid UK bank details must be provided to claim prize.
5.5. The prize is not negotiable or transferable. No cash alternative will be offered.
5.6. Unless otherwise stated in the Specific Terms, to claim the prize, you must respond within 21 days of
notification, stating you are accepting the prize and confirming the correct email/postal address to be used
to send it to you.
5.7. Please allow 30 days from claiming the prize for delivery.
5.8. The Promoter does not accept any responsibility if you are not able to take up the prize.
6. ADDITIONAL TERMS RELATING TO PRIZES THAT INCLUDE A HOLIDAY OR EXPERIENCE
If a prize includes any element of a holiday and/or experience (“Holiday Prize”), the following additional
terms will apply:
6.1. A Holiday Prize is subject to availability and must be taken in accordance with all requirements specified by
the Promoter, such as dates, destinations, carriers and number of passengers. Blackout periods may apply,
including public holidays either in the UK or the destination country in which the Holiday Prize will not be
available.
6.2. Unless expressly included in the prize description within the Specific Terms, the winner(s) will be
responsible for all ancillary expenses associated with a Holiday Prize. Examples of such expenses are
travel insurance, visas, the cost of transfers to and from airports or stations, food and drink, spending
money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are
are incidental to the fulfilment of a Holiday Prize are the responsibility of the winner(s).
6.3. You will be responsible for any vaccinations, health or visa requirements related to a Holiday Prize.
6.4. You will be responsible for ensuring that you and any person/people travelling with you are available to
travel and, if appliable, hold valid passports, any necessary visas and travel documents for a Holiday Prize
on the dates specified. Unless stated otherwise in the Specific Terms, the winner must have booked and
used a Holiday Prize within 12 months of notification of winning the Holiday Prize. Once dates are confirmed
for redemption of a Holiday Prize, they cannot be changed.
7. LIMITATION OF LIABILITY
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate a winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up a prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
8. INTELLECTUAL PROPERTY RIGHTS
8.1. All entries and any accompanying material submitted to the Promoter will become the property of the
Promoter on receipt and will not be returned. By submitting your entry and any accompanying material, you
agree to:
(a) assign to the Promoter all your intellectual property rights with full title guarantee; and
(b) waive all moral rights,
in and to your entry and otherwise arising in connection with your entry to which you may now or at any
time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to
time and under all similar legislation from time to time in force anywhere in the world.
8.2. You agree that the Promoter may, but is not required to, make your entry available on its website and any
other media, whether now known or invented in the future, and in connection with any publicity of the
competition and future marketing campaigns in connection with the Brand. You agree to grant the Promoter
a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the
competition entry and any accompanying materials, to use, display, publish, transmit,copy, edit, alter, store,
re-format and sub-licence the entry and any accompanying materials for such purposes.
8.3. Any non-Brand names are trademarks of their respective owners. The Promoter does not claim any rights in
such trademarks and unless stated in the Specific Terms the competition is not associated with or endorsed
or supported by any of such trademark owners.
9. DATA PROTECTION AND PUBLICITY
9.1. With your consent, provided as part of entering a Promotion, if you are a winner, the Promoter may use your
name and town or county of residence to announce the winner of a Promotion.
9.2. Information regarding personal data, which is provided by you when you submit your entry, will be processed
in a database for the purpose of managing this Promotion only. Such information will not be used for any
other purpose than as stated in the Terms and Conditions or as separately accepted by you. Your personal
details will at all times be kept confidential and in accordance with the UK GDPR and Data Protection Act

any inaccuracies rectified, by sending an email to consumer-gb@kenvue.com. By participating in a
Promotion, you agree to the use of your personal data as described here by the Promoter or its agents and
suppliers. You can withdraw your consent at any time by sending an email to consumer-gb@kenvue.com
but will no longer be able to participate in the Promotion and withdrawal of your consent does not affect the
legality of processing that took place prior to the withdrawal. If you have separately agreed to opt in to
receive communications from the Promoter or a third party then your personal data may be used by them
for such purposes, including direct marketing.
9.3. We may use a third-party platform, App Sorteos, to help randomly select a winner for a Promotion. When you
comment on our Instagram, Facebook or other Social Media posts, your comment and public profile handle
may be accessed by App Sorteos to run the draw. App Sorteos operates independently and processes your
data in accordance with its own Privacy Policy (Privacy Policy App Sorteos). We do not store or reuse your
data for any other purposes beyond selecting a winner.
10. GENERAL
10.1. The Promoter reserves the right to hold void, suspend, cancel, or amend the Promotion where it becomes
necessary to do so.
10.2. These Terms and Conditions, together with the relevant Specific Terms, represent the entire agreement
between you and us in relation to a Promotion and associated prize. In the event of any conflict between
the Terms and Conditions and the Specific Terms, the Specific Terms will prevail. The invalidity, illegality, or
unenforceability of the whole or any part of these Terms and Conditions or any Specific Terms does not
affect the remainder of these Terms and Conditions or any Specific Terms, which will remain in full force
and effect. These Terms and Conditions and the Specific Terms do not create any right or benefit
enforceable by any third party.
10.3. These Terms and Conditions and the relevant Specific Terms shall be governed by English law, and the
parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
